QUIKSILVER/ROXY LOYALTY SCHEME - GENERAL TERMS AND CONDITIONS OF MEMBERSHIP

 

PREAMBLE:
The "Quiksilver/Roxy" loyalty scheme (hereinafter "The Loyalty Scheme") has been developed by the company NA PALI SAS, a French simplified joint stock company (Société par Actions Simplifiée) with a capital of 3,444,300 euros, registered in the Bayonne Trade and Companies Register under number 331.377.036, with registered office at 162 Rue Belharra, Saint Jean de Luz (64500).
This Loyalty Scheme is valid in all "Quiksilver and/or Roxy" stores in the list of stores participating in the Loyalty Scheme (hereinafter "Participating Stores"), available on the websites www.quiksilver-europe.com, www.roxy-europe.com, www.quiksilver-store.com, and for purchases made on the websites www.quiksilver-store.com and www.roxy-europe.com.


1. Acceptance of general terms and conditions of membership


The Customer acknowledges having read and accepted the general terms and conditions of membership to the Loyalty Scheme set out hereafter. The full general terms and conditions of membership to the Loyalty Scheme are freely available on the websites www.quiksilver-europe.com, www.roxy-europe.com, www.quiksilver-store.com or upon request from the reception of Participating Stores.


2. Principle of Loyalty Scheme


This document sets out the general terms and conditions of the Loyalty Scheme: customers collect points for each purchase made in one of the Participating Stores or online on the websites www.quiksilver-store.com and www.roxy-europe.com.
The points collected allow customers to receive benefits, which are set out hereafter. The points can be collected once a loyalty card has been obtained upon first purchase in one of the Participating Stores or online on the websites www.quiksilver-store.com and www.roxy-europe.com.


3. Membership of Loyalty Scheme


To be a member of the Loyalty Scheme, customers simply need to obtain a loyalty card from one of the Participating Stores, then complete the Loyalty Scheme membership form by logging onto one of the websites www.quiksilver-europe.com, www.roxy-europe.com or www.quiksilver-store.com.
Membership is strictly personal, and only the member can receive the benefits described below.
The Loyalty Scheme is offered only to customers, who must be natural persons of at least 14 years of age, residing in one of the member States of the European Union or in Switzerland. For natural persons aged under 18, membership of the Loyalty Scheme requires the consent of the minor's legal representative.
The loyalty card is free, and can be issued without any obligation to purchase.
The loyalty card is personal.
NA PALI SAS reserves the right to check compliance with the general terms and conditions of the Loyalty Scheme.
The customer guarantees the accuracy of all information provided and shall be solely responsible for any erroneous, incomplete or obsolete information. Any erroneous, incomplete or obsolete applications for membership of the Loyalty Scheme will not be accepted.


4. Benefits of the Loyalty Scheme


4.1 Collecting points: The holder of the loyalty card presents it each time they pass through the till or enters the loyalty card number when making a purchase online, in order to credit the number of points earned by the purchase, according to the operations in force.
Each time a customer passes through the till and presents the loyalty card or makes an online purchase, they receive:
- 10 loyalty points for each purchase made, on the basis of one visit per day
- and 1 loyalty point per Euro or Pound Sterling spent (1 Euro / £1 = 1 point), excluding purchases of products in the sales, promotions, and excluding purchases made with gift vouchers or exchanged goods.
However, purchases made prior to acquisition of the loyalty card will not be included.

The holder of the loyalty card may consult their points balance at any time by accessing their account on the websites www.quiksilver-europe.com or www.roxy-europe.com or www.quiksilver-store.com.
The loyalty card may not under any circumstances be used as a method of payment. The loyalty points do not have any commercial value and cannot be transferred.

4.2 Loyalty discounts: Once 500 points has been reached, members of the Loyalty Scheme will receive an e-mail giving them a discount voucher (gift voucher) for a single purchase of a value of 25 euros or £20. When this is used, the loyalty account will be debited 500 points.
This discount will be deducted from the amount of the purchase, regardless of its value.
If the product is returned for an exchange or refund, the amount of discount used will not be re-credited to the loyalty account. 

4.3 Privileges and events:
- Invitations: according to the operations in force, invitations will be reserved for holders of loyalty cards. The invitations are personal and are only for the holder of the loyalty card.
- Product exchange without till receipt: members of the Loyalty Scheme have one month in which to exchange products and, thanks to the loyalty card, can do so without presenting the till receipt. Products must however be returned in their original condition and packaging (no exchange will be possible otherwise).
- Copy of bill without till receipt: members of the Loyalty Scheme can consult their transactions at any time, and access the details of their transactions on the websites www.quiksilver-europe.com or www.roxy-europe.com or www.quiksilver-store.com.
These documents can be printed.


5. Gift vouchers

Gift vouchers representing a discount of 25 euros or £20 are valid in all Participating Stores in the Loyalty Scheme (list can be consulted on www.quiksilver-europe.com, www.roxy-europe.com, www.quiksilver-store.com).
These vouchers are valid for 12 months after their date of issue, for all brands in the NA PALI SAS Group, and may not be exchanged for any cash, in full or part, when they are used.
The vouchers cannot be used with any other operation, promotion or sale.


6. Loss or theft


If the loyalty card is lost or stolen, the member of the Loyalty Scheme must notify Quiksilver Customer Services as quickly as possible. The account will be cancelled and replaced by a new one. The benefits acquired will not be lost due to this replacement. The card will then be replaced by a new loyalty card.


7. Change of address


Any change in the member's contact details given on the membership form must be directly notified on the website www.quiksilver-europe.com or www.roxy-europe.com or www.quiksilver-store.com. The customer guarantees the accuracy of all information provided and shall be solely responsible for any erroneous, incomplete or obsolete information. Any incomplete, illegible or deleted changes will not be accepted.

8. Fraudulent use of the loyalty card


Any breach of these general terms and conditions of membership, any fraudulent use by the member of the Loyalty Scheme, or by any third party acting on behalf of the member, shall as of right deactivate the loyalty account.
The points acquired by breach of these general terms and conditions of membership or by abusive or fraudulent use shall be cancelled without any compensation.
NA PALI SAS reserves the right to check compliance with the general terms and conditions of using the Loyalty Scheme.


9. Modification or suspension of the loyalty scheme


NA PALI SAS reserves the right at any time to modify the Loyalty Scheme general terms and conditions of membership  without being required to justify its decision. If the general terms and conditions of membership are modified, NA PALI SAS will inform its members.

10. Data Protection

Under French Law No. 78-017 of 6 January 1978 concerning Data Protection, members of the Loyalty Scheme are informed that the information provided on the membership form is required to process and activate the loyalty card and to access the information in the loyalty account. Members are informed that the personal data collected under this Loyalty Scheme will be processed electronically.
Data concerning the member will be used by Quiksilver Europe to tell the member about offers and news.
Members are informed that they have the right to access, correct and remove any information concerning them and to refuse information on our offers. This right can be exercised by writing to the following address or via their personal access on the websites www.quiksilver-europe.com or www.roxy-europe.com or www.quiksilver-store.com.

11. Applicable Law


This Loyalty Scheme and its general terms and conditions of membership are governed by French law.
